DAILY NEWS WEEKLY : Florida judge’s harsh sentence over jury duty & man sues over wife’s affair

 

Welcome ladies and germs to another episode of Daily News Weekly, where we highlight the stories from the past week that you might have missed. I’m your host Michael Sheridan. Now this is a classic tale of boy meets girl, boy and girl get married, girl then apparently cheats on boy, boy and girl get divorced then boy sues another boy for having the affair with girl. Yeah. Robert Kevin Howard was happily married in 2005. Now about a decade later he discovered that his wife had been cheating on him, she admitted to it and they got a divorce and the heartbroken husband then decided to sue the man who had been sleeping with his wife, or ex-wife, or his wife at the time then his ex-wife.

Now the couple lived in North Carolina, and this is one of the very few states in the Union that recognizes the alienation of affection tort. Now to put it simply this means that a spouse can hold accountable and sue a person for essentially interfering in a marriage and causing that spouse to be deprived of the love and affection of their husband and wife. Now Howard ultimately won his case, and was awarded $750,000 and part of that reason is because according to NBC News, Howard’s attorney successfully claimed that the man who had the affair with Howard’s wife who was somebody that Howard knew, was aware or had to be aware that what he was doing was ultimately going to ruin the marriage. Now before any of you jilted husbands and wives try to rush out there and see if you can file a lawsuit, the alienation of affection tort is actually really rare.

Only five states in the country actually allow it, including South Dakota I believe, North Carolina, Hawaii, Mississippi, and Utah.

Now I wonder if there’s a statute of limitations that would prevent me from going after Neil Klepture for kissing Judy Pepper under the bleachers in fifth grade. He knew I was crazy about her. Neil. It was a heartwarming tale of a US Army veteran who passed away at the age of 80 all alone and then, thanks to social media, thousands of people came out to attend his service.

Except it wasn’t true.

And turned out he did have a family that he abandoned. This is US Army veteran Edward Pearson. A funeral home put out word on social media that he had no family to attend his funeral. The story went viral and ultimately up to 4,000 people attended his funeral.

However, according to the Sarasota Herald Tribute, Pearson did have family. Two sons, in fact, who he abandoned decades earlier and for years had thought he was dead. Edward Pearson Junior hadn’t seen or heard from his father since 1983. He told the Sarasota Herald Times that his father had left him and his brother when they were just teenagers and never paid child support. And then ultimately remarried.

And in 1992 got divorced from that woman. Then that woman apparently told Pearson Junior’s mother that Edward had died after being electrocuted. Not it isn’t quite clear why the woman told the family that Pearson Senior had died, but they assumed he was gone until these stories started popping up on social media about the funeral. Now Pearson Junior does claim that he did reach out to the funeral home before the service and told them that he did in fact have family, he has two sons, but the funeral home never shared this information, never told anybody that they had been contacted by the family. I suppose there’s any number of reasons why the funeral home wouldn’t have done that.

It was kind of late in the game, it was apparently like a day or two before the funeral was supposed to take place.

I’m sure it would have turned out to be maybe a little embarrassing or whatever. Or if you winna be cynical, you know, their kind of promotional stunt to create a lot of attention for this funeral would have been ruined if they then had revealed the fact that the man actually did have family. Either way, it’s a weird twist in a story that should have been a heartwarming tale and unfortunately, it seems like these weird twists happen way too often these days. Now at the top of last week’s episode, we talked about a Mets fan who got hit by a t-shirt in the face from one of those t-shirt cannons and apparently got injured or claims to have been injured and is now suing over it. And apparently also wants to ban the t-shirt cannons. James Hodgen on Facebook said,”Maybe pay attention at the games, just saying’.”And Tony Glines on Facebook said,”Stay off your phone at the ball game.”

Actually, several people kind of made that same similar comment.

I don’t know that he was on his phone, and I don’t know if he wasn’t paying attention.

But that’s what a lot of comments seem to be going towards. We also tried something interesting on Facebook at least last week is we put a poll in and asked the question, “Should t-shirt cannons be banned?” And 34% said yes, 66% said no. I think that’s actually pretty cool and I was really glad to see people really participate in the poll. I was just a little disappointed to see that Facebook doesn’t give you any data.

So, I don’t actually know how many of the viewers voted in the poll.

It could have just been a few people or a lot of people. But those were the results. And, Facebook, maybe you should do something to give us more data from the polls. Now this story is just nuts.

It all started when Holly Persic was taking her car out for a drive to go to the library in Pennsylvania. That’s when she started smelling something burning. When her and her husband Chris investigated the car, they opened up the hood, and discovered something crazy, this. According to the husband, there were about 200 walnuts and a ton of grass in their engine. Now it’s not uncommon for squirrels to find little nooks and crannies like that to store away their nuts, especially this time of year as winter approaches.

But this is definitely not a normal squirrel. This looks like a hoarder squirrel.

Now fortunately, in this particular case, the engine didn’t suffer any significant damage, but be warned. Squirrels are out to get you. They are out to take over the world and they are doing it one nut at a time.

A 21 year old college student in Florida made the bad decision to blow off jury duty and it turned his life upside down. Deandre Sommerville, from all reports, is a decent young man who has never been in trouble with the law. In August, he overslept and missed his jury duty. So instead he went to work that afternoon. Now according to Palm Beach County Circuit Judge John Kastrenakis, Sommerville didn’t call in to explain himself and when the court reached out to him to try to get an explanation as to why he didn’t show up, he didn’t respond.

So, the judge held him in contempt of court. As a result, Sommerville spent 10 days in prison. In addition, he was gonna have 12 months of probation and was ordered to serve 150 hours of community service. Now when news got out about this, it sparked outrage. And there were calls of racism in the sense that because the 21 year old is black and the judge was white, he was being singled out and given very harsh sentence because of his race.

The judge denies this and claims race had nothing to do with it. In fact, he argues that Palm Beach County has a problem with people not showing up for jury duty. It happens quite a lot. According to WPEC 12 News, only about 30% of those summoned in Palm Beach County ever show up or serve jury duty. So the argument there is that it’s causing a lot of problems and they’ve been struggling to try to find ways to deal with this issue.

But what do you think? I mean, is there any way to know whether or not this is about race or was this just about a criminal justice system run amok where they applied too harsh of a sentence on something that’s very minor? Or is the court justified in trying to do something to stop people from skipping jury duty? If nothing else seems to work, maybe harsher penalties are the answer.
